Matching Samples
Due to the reflective characteristics of some materials and the photographic spectral response of our materials, it is not always possible to match your originals. When reordering, please enclose a print from the previous order. To prevent a remake, enclose a sample, chip or transparency with original order.

Remakes
If a remake is necessary, we require that you:
(1) Return all material.
(2) Return your copy of original order.
(3) Provide clear instructions as to what is to be corrected.
(4) Remake requests must be made within 5 days of receipt of original order.

Note:
Orders taken on a “Print Regardless” basis will be printed with a clear understanding that the results may fall short of our normally acceptable professional standards. There will be no remakes on “Print Regardless” orders.

Terms
Net 30 days to Open Accounts. Accounts more than 90 days past due are placed on C.O.D.
C.O.D. accounts may require a deposit with order.

LEGAL

Sales Tax
All shipments delivered in Michigan will be charged sales tax unless Tri-Color Photographic, Inc. has on file a signed Michigan Sales Tax Exemption Certificate, or a written Purchase Order indicating tax exemption with purchaser’s tax license number.

Reproduction of Copyrighted Materials
Purchaser represents and warrants that by requesting Tri-Color Photographic, Inc. to reproduce any copyrighted work, purchaser has either: (A) Obtained permission from the copyright owner to reproduce, distribute and display such copyrighted work, or (B) Will use the reproduction prepared by Tri-Color Photographic, Inc. solely for teaching, research, criticism or comment, and will refrain from using the reproduction in any other manner which is to the financial benefit of the purchaser and the financial detriment of the copyright owner. Purchaser agrees to hold harmless and to indemnify Tri-Color Photographic, Inc. for all cost, expenses or judgments resulting from any claim or lawsuit against Tri-Color Photographic, Inc. for copyright infringement or any claim or lawsuit against Tri-Color Photographic, Inc. at the request of the purchaser.

Limit of Liability
The safeguarding of property and material while in our possession is a foremost objective of Tri-Color Photographic, Inc. Submitting any film, print, slide or negative to this firm for processing, printing or other handling constitutes an AGREEMENT by you that any damages or loss by our company, subsidiary or agents, even though due to negligence or other fault of our company, subsidiary or agents will only entitle you to replacement with a like amount of unexposed film and processing. Except for such replacement, the acceptance of film, print, slide or negative is without other warranty or liability, and recovery for any incidental or consequential damages is excluded. Tri-Color Photographic, Inc. does not assume liability for purchaser supplied materials, such as picture frames, paintings, prints, artwork, color guides, or other materials which are submitted with orders, whether lost or damaged through theft, negligence or any other means. Tri-Color Photographic, Inc. is not responsible for any loss or damage to materials submitted for mounting but not processed in our lab. Because color dye stability, in some cases, may change over time, Tri-Color Photographic, Inc. cannot warrant against color shift.
Tri-Color Photographic, Inc. shall not be liable for any other damages and in no event shall it be liable for any consequential damages here under.
